The Pakistan Telecommunication Authority (PTA) has expressed serious concerns over moving forward with the 5G auction, citing ongoing legal cases surrounding the 140 MHz spectrum as a major hurdle.
The PTA chairman shared these reservations during a meeting of the National Assembly Standing Committee on IT’s Sub-Committee, chaired by Barrister Gohar.
The PTA chairman told lawmakers that launching a 5G auction under the shadow of unresolved court cases could have adverse consequences.
“Until the 140 MHz spectrum is cleared by the courts, the auction of 5G will be risky,” he stated. He also highlighted that telecom operators themselves have reservations, adding that legal uncertainty could deter participation and disrupt investment in Pakistan’s digital future.
However, not everyone in the meeting agreed with the PTA's stance. Member Legal from the Ministry of IT argued that there is no stay order on the spectrum in question, making it legally viable to proceed with the auction. Barrister Gohar also supported this viewpoint, stating, “The cases will continue, but when the 5G frequency is already under PTA’s ownership, there is no legal restriction on auctioning it.”
The meeting underscored the divide between regulatory caution and political urgency. Barrister Gohar emphasized the critical need for 5G technology, especially in underdeveloped regions. “We need 5G frequencies in tribal areas, but instead, you are getting entangled in legal complications. The auction must go on,” he remarked.
During the session, it was revealed that various telecom companies have also expressed hesitation about participating in the 5G auction while legal proceedings remain unresolved. The PTA chief reiterated that even in the absence of a formal stay order, the possibility of companies obtaining injunctions could stall the entire process.
Committee member Sharmila Faruqui questioned whether the PTA’s hesitation stemmed from legitimate legal barriers or just fear of complications. “Is it just your fear that the 5G auction cannot be held, or are there any solid reasons?” she asked.
In response to the ongoing concerns, the sub-committee decided to summon telecom companies in the next meeting to hear their stance on the pending legal matters. The committee also agreed to review all court decisions related to the spectrum before making a final call on the auction timeline.
The PTA chairman added that he had personally requested the prime minister to ensure that court cases related to 5G are resolved quickly.
