The Judicial Commission of Pakistan has released its new rules following a recent hearing regarding appointment of the judges in the high courts.
Under the updated regulations, the appointment of new judges to the High Courts will now be based on legal experience, qualifications, ability, and eloquence. In addition, the commission's proceedings will be conducted in camera, ensuring confidentiality.
According to the final draft, the Chief Justice of High Courts will be selected from among the three most senior judges.
The senior-most judge must provide a reason if they are not appointed as the Chief Justice. All commission members will have the authority to nominate candidates for additional High Court judgeships, but the final appointment will be contingent on a comprehensive evaluation of the candidate's educational background, legal experience, and competence. A broad-minded approach will also be necessary for consideration.
For the first time, judicial officers, alongside lawyers, will be represented in the selection process for new judges.
A performa for evaluating prospective judges has also been incorporated into the rules.
While the decisions of the commission will be made public, the discussions held during the proceedings will remain confidential, and members are prohibited from disclosing any details of the discussions.
