SHC allows partial ban on motorbikes on Ashura

Staff ReportKARACHI: Sindh High Court (SHC) allowed the provincial government to impose ban on use of motorcycles on 9th and 10th Moharramul Haram in the metropolis, directing to issue a notification clearly specifying the areas of the ban, to SAMAA reports Tuesday.It should be mentioned here that the Home Department prayed to the court to allow the ban on motorcycling across the city; however, the plea has been turned down.The SHC allowed the government to impose the ban only on public holidays in Karachi, if needed; however, it stressed that the ban cannot be imposed across the city on working days.Appearing before the court hearing a petition filed by the Sindh government’s Home Department seeking judicial permission for the government to impose ban on motorcycles in the city, Advocate General Sindh Abdul Fatah Malik said motorbikes are more likely to be used in terrorist activities.Additional Advocate General Sindh, Adnan Kareem pleaded the court to allow imposing the ban on particular places till 10th of Moharram if needed, adding the November 18 blast claimed lives of two people and caused injuries to 19 others.The Bar Association argued that the government should declare a public holiday instead of enforcing a ban on motorbikes throughout the city.The SHC remarked it is permissible to proclaim the ban on parking the motorbikes around imambargahs and the mourning processions and rallies being convened in the metropolis. The parking place should be allotted away from the venues for the public gatherings and imambargahs.Sindh High Court Bar Association’s counsel Shahab Sirki said the government cannot ban the motorcycles in the city, as it stands in contradiction with human rights, adding if the security risks are involved, the government should go for public holiday on that particular day. The hearing was indefinitely adjourned. –SAMAA
