Staff ReportISLAMABAD: Chief Justice of Pakistan (CJP) Iftikhar Muhammed Chaudhry Wednesday said president of the State is head of the country not a particular party; hence, to him, every citizen is equal even if he hailed a hailed from a backward rural area.Pleading before an eleven-member bench of the Supreme Court (SC) hearing Zulfikar Ali Bhutto Reference case, Sindh Advocate General Abdul Fattah Malik said there is still a question mark on Bhutto’s execution, adding the judiciary has been sought its opinion in the reference sent by President Asif Ali Zardari.The Chief Justice Chaudhry remarked that pathway of the military courts have been blocked; accordingly, no one should develop any illusions. The CJ asked the Sindh AG to present any single precedent regarding the reference sent by the head of any state for revisit.Justice Sarmad Usmani said Article-186 of the Constitution encapsulates the reference based on the legal question of public importance alone, adding, ‘Has any such legal question been raised in the present reference?’Replying to this, Sindh AG contended the transparent trial and disinterested hearing are also legal questions. Justice Usmani said the Reference was sent by the president; hence, making it an example, a common man can follow suit.The AG Malik said the court has powers to dismiss a reference if it is off the mark. Justice Usmani said the court has also to deternine as to which question can be sent for reference. The AG Malik said the ZAB was not a common man; instead, he is the one who gave the present Constitution. Justice Saqib Nisar queries if the Parliament is empowered to look into such matter. Reacting to this, the AG said the court may send this matter to the Parliament to decide it.Dispelling the impression that the court is not providing results, the Chief Justice Chaudhry said the judiciary is not to look at the opposition.Opening his arguments on the maintainability of the Reference, former Federal Law Minister Babar Awan contended Article-186 of the Constitution is singular and the office of the President is quite different. But, the CJ Chaudhry said the President is head of the country not a chief of a particular party; hence, for him, all citizens are equal, adding as regards the re-opening of the case at hand, everyone else will take recourse to the court for the purpose.Awan said he is happy that the way of military courts has been impeded. Chief Justice said this way will remain closed; hence, nobody should think otherwise.No one will venture any unconstitutional step as long as the judiciary stands by the Constitution, the CJ noted.
