The Supreme Court of India has sought a response from actor Karisma Kapoor after Priya Kapur filed a plea requesting access to divorce records related to Karisma and her late former husband, Sunjay Kapur.
The case has raised questions around privacy, inheritance, and the use of court records in succession disputes.
The Supreme Court heard Priya Kapur’s petition seeking certified copies of divorce-related records between Karisma Kapoor and Sunjay Kapur. The court directed Karisma to formally place her objections on record.
She has been given two weeks to submit a detailed response outlining her stance on the request.
During the hearing, Karisma Kapoor’s counsel strongly opposed the application. According to an attorney quoted by news agency ANI, the plea was described as frivolous.
The lawyer argued that the request was an attempt to access personal and confidential information that had no justification for being made public.
Family voices concern over privacy
Sunjay Kapur’s sister, Mandhira Kapur Smith, also criticised the move. Speaking to ANI, she said the attempt to obtain the divorce records was unnecessary and based on a flawed assumption.
She stressed that if Sunjay Kapur had intended the documents to be public, he would have done so earlier. Mandhira also termed the issue sensitive, particularly in light of the children involved.
What Priya Kapur’s application claims
In her plea, Priya Kapur stated that she is the legal heir to Sunjay Kapur’s estate as his legally wedded wife. She sought certified copies of records related to Transfer Petition (Civil) No. 214 of 2016, filed during Sunjay and Karisma’s divorce proceedings.
According to the application, these documents are required for ongoing succession proceedings in the Delhi High Court.
Background
The transfer petition filed by Sunjay Kapur in 2016 sought to move the divorce proceedings from Mumbai’s Family Court to Delhi. The Supreme Court heard the matter on April 8, 2016, after both parties reached an amicable settlement.
The court recorded the detailed consent terms, effectively closing the dispute. Sunjay Kapur later married Priya Kapur on April 3, 2017.
Sunjay Kapur passed away on June 12, 2025. Following his death, Priya Kapur’s legal team stated that she is pursuing clarity on her husband’s estate and legal affairs.
They argue that access to the divorce records is essential to establish claims linked to inheritance proceedings.
